These Service Terms and Conditions (“Service Terms”) govern the ordering, supply and delivery of products and services offered through durianpark.com (the “Website”), operated by Wizleo Equity Management (Malaysia) Sdn Bhd (“DurianPark”, “we”, “us” or “our”). These Service Terms should be read together with our Terms of Service, Privacy Policy, Shipping Policy, Payment Policy and Refund Policy. By placing an order with us, you agree to be bound by these Service Terms.
1. Our Products & Services
DurianPark supplies fresh durian, frozen durian, durian-based pastries, ice cream and related products, together with packing and delivery services within Malaysia. As durian is a natural, seasonal and perishable agricultural product, variety availability, grade, size, taste and ripeness may vary between harvests and are subject to seasonal supply.
2. Eligibility
You must be at least 18 years of age, or have the consent of a parent or legal guardian, and be able to form a legally binding contract to place an order. You agree to provide accurate, current and complete information when placing an order, including a valid delivery address and contact number.
3. Orders & Order Acceptance
- An order placed through the Website is an offer by you to purchase the products at the listed price.
- All orders are subject to acceptance and product availability. We will confirm acceptance of your order by sending an order confirmation to your registered email.
- We reserve the right to refuse, cancel or limit any order, including where stock is unavailable, where there is an error in the price or product description, or where we suspect fraudulent activity.
- A binding contract is formed only when we issue the order confirmation.
4. Pricing
All prices are listed in Malaysian Ringgit (MYR) and, unless stated otherwise, are inclusive of applicable taxes. Delivery charges, where applicable, are calculated and displayed at checkout. We make every effort to ensure prices are accurate; however, in the event of a pricing error we will contact you before processing your order. Prices for seasonal durian may fluctuate in line with market and harvest conditions.
5. Delivery & Fulfilment
Delivery timelines, coverage areas, packaging (including chilled and frozen packaging for perishable items) and charges are set out in our Shipping Policy. As our products are perishable, please ensure that someone is available to receive the order at the scheduled delivery time. We are not responsible for deterioration in product quality caused by a failed delivery, an incorrect address, or a customer’s failure to receive or refrigerate the product promptly upon delivery.
6. Product Quality & Nature of Perishable Goods
We observe strict quality control to deliver fresh, high-quality durian and durian products. By their nature, durians are sold as whole or processed natural produce, and characteristics such as flesh colour, texture, seed size and bitterness are natural variations and not defects. Photographs on the Website are for illustration purposes. Should you receive a product that is genuinely defective or spoiled on arrival, please refer to our Refund Policy and contact us within the stated timeframe.
7. Customer Responsibilities
- Provide accurate delivery and contact details.
- Be available to receive perishable goods at the agreed time, or arrange a suitable recipient.
- Store and consume perishable products promptly and in accordance with any handling instructions provided.
- Use the Website lawfully and not engage in fraudulent, abusive or disruptive activity.
8. Intellectual Property
All content on the Website, including text, graphics, logos, images and the “DurianPark” brand, is the property of Wizleo Equity Management (Malaysia) Sdn Bhd or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute or use any content without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability arising out of or in connection with any order shall not exceed the amount paid by you for that order. We shall not be liable for any indirect, incidental or consequential loss. Nothing in these Service Terms excludes liability that cannot be excluded under Malaysian law, including the Consumer Protection Act 1999.
10. Force Majeure
We shall not be liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including but not limited to adverse weather, crop failure, natural disasters, strikes, transportation disruptions, or acts of government.
11. Governing Law
These Service Terms are governed by and construed in accordance with the laws of Malaysia, and you submit to the exclusive jurisdiction of the Malaysian courts.
12. Amendments
We may update these Service Terms from time to time. The latest version will always be published on this page with the effective date shown above. Continued use of the Website or placing of orders after changes are posted constitutes acceptance of the updated terms.
